Bookings
Bookings are subject to the following terms and conditions which are agreed to at the time of booking. A contract between customers and the owners comes into existence when payment is received. The contract binds you and all members of the party. Failure to disclose all relevant details as per booking terms will result in the cancellation of the booking.
Deposit
A non-refundable deposit is required to make the booking. Bookings made less than 8 weeks prior to arrival must be paid in full.
Balance of Payment
Balance of payment must be paid 8 weeks prior to arrival. Should a balance not be received, this will be interpreted as a cancellation, and the outstanding balance will remain due to be paid.
Holiday Insurance
Holiday insurance taken out by you is considered essential to cover any situation or illness (including Covid-19) that means you have to cancel at any point.
Cancellation by Us
Cancellation by us would only be in exceptional circumstances beyond our control. Notification would be given as soon as possible and a refund made. Our liability for cancellation will be limited to payments made to us. Should an issue occur with your choice of accommodation, we would, if possible, and depending on availability, offer an alternative option.
Changes by You
Changes made by you to dates will incur a £50 administration charge. Changes cannot be made within 12 weeks of your arrival.
Responsibility
We will not accept responsibility for material loss, damage, additional expense, or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, heating, electrical services, or exceptional weather. We cannot be held responsible for travel disruptions resulting in non-arrival because of bad weather.
Natural Hazards
The grounds at Craighead include natural hazards due to the country setting, including, but not limited to, limited lighting, uneven paths, deep ponds, fences with electrical wire, etc. You are advised to make yourself aware of these hazards and to bring and utilise a torch after dark. Children must be in the company of an adult at all times. Children are not the responsibility of Craighead Farm, and the owners cannot be held responsible or in any way to blame should any harm befall them.
Right of Entry
We or our representative reserve the right to enter the property at any time to undertake essential maintenance or for inspection.
Occupancy
Occupation of the accommodation commences at 3 pm and concludes at 10 am on the day of departure.
Maximum Number of Guests
The maximum number in your accommodation must not exceed the number on the booking form. Day visitors are not allowed on the site.
Smoking and Candles
Smoking and the use of candles and tea lights (except where one was provided by us in an appropriate container) will result in the termination of the occupancy and no payments will be refunded. Under no circumstances must candles and tea lights (other than as described above) be used in your accommodation.
Pets
Pets are not allowed on site or in any accommodation.
Vehicles
Vehicles and contents are left at the owner’s risk. Vehicles must be parked in designated spaces.
Damage and Loss
By booking with us, you are accepting responsibility for any breakages, damage, or theft. You must inform us of any damage before departure. You may be charged for any damage or loss found.
Additional Cleaning
Should the property be left in an unacceptable condition, we reserve the right to charge for additional cleaning.
Loss of Keys
Loss of keys or failure to return keys will result in charges for replacement.
Noise and Behaviour
Craighead is a quiet site, therefore noise must be kept to a reasonable level at all times to ensure you are not disturbing others. Noise must be kept to a minimum level after 10 pm. Music must not be played outside. Disruptive behaviour or behaviour deemed to be inappropriate will result in the persons responsible being asked to leave immediately, and the booking terminated without compensation.
Pond Use
The pond must, under no circumstances, be used for paddling, swimming, or fishing.
Prohibited Activities
The flying of kites, model aircraft, Chinese lanterns, or the use of fireworks is strictly prohibited.
Complaints
Should you have any complaint regarding your stay with us, you should speak to us at the time and we will endeavour to put matters right. Any complaint not reported directly to the proprietor or representative at the time will not be considered at a later date.
Departure
By booking with us, you agree to leave the accommodation clean, tidy, and undamaged. This requires all dishes to be washed, dried, and put away. Obvious spills and stains must be removed. All rubbish must be removed and appropriately placed in the correct bins, including food waste.
Amendments
We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.
Respect for Property
Craighead is privately owned and is our home. We expect all guests to enjoy themselves and the facilities whilst treating it with the same respect they would their own home.
Force Majeure
Our terms and conditions also include the following Force Majeure clause: We – Craighead Howfs – are not liable for refunds or expenses that you incur in the event we are prevented from fulfilling your booking as a result of circumstances beyond our control. Such circumstances shall include (but not be limited to) war, terrorism, riots or civil unrest, industrial action, flooding, natural disaster, epidemics, pandemics, health risks, or similar (Force Majeure) events. We recommend that you have adequate holiday insurance to cover this.
Liability
Under no circumstances shall the proprietor’s liability to the client exceed the amount paid to them for the rental period. This contract shall be governed by Scots Law in every particular, including formation and interpretation, and shall be deemed to have been made in Scotland. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in Scotland.
